Normative ethics concerns the criticism and justification of morality, law, and other systems of norms. The article tries to inquire a third way in normative ethics between consequentialism or utilitarianism and deontology or Kantianism. To find such a third way in normative ethics, one has to analyze the elements of these classical theories and to look if they are justified. In this article it is argued that an adequate normative ethics has to contain the following five elements: (1) normative individualism, i. e., the view that in the last instance moral norms and values can only (...) be justified by reference to the individuals concerned, as its basis; (2) consideration of the individuals' concerns and interests—aims, desires, needs, strivings—insofar as they have a justificatory function; (3) a pluralism of references of these concerns and hence of moral norms and values to all possible elements of actions; (4) the necessity of a principle of aggregation and weighing with regard to these concerns; (5) finally, as a central principle of aggregation and weighing, the principle of relative reference to self and others, operating as a generalizing meta-principle that guides the application of concrete principles and decisions. The contribution starts with the observation that Kant mentioned Human Dignity in his main works with great variety in emphasis. In the 'Grundlegung' from 1785 we find a significant treatment and again in the 'Tugendlehre' from 1798 but none in the 'Kritik der Praktischen Vernunft' from 1788 and in the 'Rechtslehre' from 1797. This needs an explanation. In the 'Grundlegung' human dignity is not attached to the second formula of the categorical imperative, the formula of self-purposefulness, as it is often (...) assumed, but to the third formula of a kingdom of ends. It is there explained as self-legislation. This placement needs also an explanation, which is attempted by the article. In the 'Tugendlehre' human dignity is then explained as self-purposefulness. So Kant changed his understanding of human dignity from the 'Grundlegung' to the 'Tugendlehre'. But the question is: why? (shrink)

Eine Analyse der Politischen Philosophie der Neuzeit kann – soll sie nicht lediglich einzelne Autoren oder Werke reihen – zwei methodische Wege einschlagen. Sie kann zum einen mit einer detaillierten Werkinterpretation wichtiger Denker wie Hobbes, Locke oder Kant beginnen und quasiinduktiv den historischen Fortgang der Hauptdiskussionen zu rekonstruieren suchen. Sie kann aber auch wesentliche abstrakte Verlaufskategorien vorschlagen, mit deren Hilfe dann umgekehrt in einem quasideduktiven Konkretionsschritt die Beiträge eminenter Denker möglichst gut verstanden, eingeordnet und gewürdigt werden.Der vorliegende Text wird zum (...) Zweck der Beurteilung dieser beiden großen Alternativen zunächst einige Anforderungen vorschlagen, die derartige abstrakte begriffliche Kategorien erfüllen sollten, um zum Verständnis der Ideengeschichte der neuzeitlichen Politischen Philosophie beitragen zu können . In einem zweiten Schritt werden die beiden soeben genannten Gegensatzpaare an Hand dieser Anforderungen beurteilt . Diese Beurteilung wird zu dem Ergebnis führen, daß beide Gegensatzpaare zwar unabdingbar notwendig sind, um wesentliche Autoren der Politischen Philosophie der Neuzeit würdigen zu können. Für die Erfassung des Verlaufs der grundlegenden Auseinandersetzung in der neuzeitlichen Politischen Philosophie reichen sie aber nicht aus. Deshalb wird drittens das schon im Titel dieses Beitrags genannte Kategorienpaar „Normativer Individualismus versus normativer Kollektivismus" vorgeschlagen . Mit Hilfe dieses Gegensatzpaares und einiger Ergänzungen wird dann viertens die Grundlinie der Auseinandersetzung in der neuzeitlichen Politischen Philosophie skizziert werden . Welches Recht ist gerecht? So lautet die Grundfrage der Rechtsethik. Die Rechtsethik fragt also nach der Rechtfertigung und Kritik des Rechts. Dabei geht es ihr nicht nur wie der dogmatischen Rechtsanwendung um die Analyse der Normen und Wertungen des geltenden Rechts, sondern um einen ethischen Maßstab des Rechts.

Are Andy Warhol’s Brillo Boxes works of art? This article investigates the concept of art in regard to this question in six steps. (1) First, the radical challenge of art in modernity is explained. (2) Second, the concept of art in the history of philosophy is explored. (3) What follows is a discussion of three suggestions on how to understand the concept of art. (4) In the fourth step the question of the concept of art is framed more abstractly and (...) a discussion regarding its relationship between the contingent and necessary elements is offered. (5) As a result of this investigation some elements of the concept of art are suggested. Alle Entscheidungen sind in letzter Instanz durch den Bezug auf die betroffenen Individuen zu rechtfertigen – so lautet die zentrale Annahme des normativen Individualismus. Der Beitrag entfaltet, präzisiert und begründet diese These für den Bereich der politischen Ethik. Den Abschluß bildet eine Skizze von Realisationen des normativen Individualismus im deutschen Recht.

Der Beitrag entfaltet eine normative Ethik mit folgenden fünf Elementen: den normativen Individualismus als Ausgangspunkt, die Berücksichtigung der Ziele, Wünsche, Bedürfnisse und Strebungen aller betroffenen Individuen als rechtfertigende Eigenschaften, einen Pluralismus des Bezugs dieser Belange auf alle möglichen Elemente unseres Handelns, die Notwendigkeit eines Zusammenfassungsprinzips dieser Belange, schließlich als Zusammenfassungsprinzip das sog. Prinzip der relativen Individual- und Anderer- bzw. Gemeinschaftsbezogenheit.

Der Aufsatz versucht die alte Frage nach dem Charakter des Rechts, das heißt in philosophischer Perspektive, nach den am wenigsten veränderlichen Eigenschaften des Rechts bzw. dem Rechtsbegriff, neu zu stellen und eine Antwort zu geben. Nach der hier vertretenen Auffassung muss ein adäquates Verständnis des Rechts sowohl seine Ziele als auch seine spezifischen Mittel berücksichtigen. Das wesentliche Ziel des Rechts liegt in der Vermittlung zwischen möglicherweise gegenläufigen, konfligierenden Belangen. Von anderen Sozialordnungen mit demselben Ziel wie der Moral, der Politik oder (...) der Religion unterscheidet sich das Recht u. a. durch seine Äußerlichkeit, seine Formalität und seine Immanenz. Die Frage nach der Gerechtigkeit wurde in der Antike vor allem als Frage nach dem tugendhaften Leben und Handeln verstanden. In der Gegenwart wird dagegen stärker die politische und soziale Gerechtigkeit thematisiert. Diese einzelnen historischen Akzentuierungen dürfen jedoch nicht über den grundsätzlichen Charakter der Gerechtigkeit als Teil der allgemeinen Ethik hinwegtäuschen.

Zum Verständnis des Kantschen Rechtsbegriffs ist es notwendig, sich die Diskussionslage seiner intellektuellen Umgebung vor Augen zu führen, auf die nach längerer Ausarbeitung 1797 sein rechtsphilosophisches Hauptwerk Die Metaphysik der Sitten. Metaphysische Anfangsgründe der Rechtslehre traf. Die Naturrechtsentwicklung des 18. Jahrhunderts hatte – zumindest in Deutschland – zur Herausbildung eines engeren, äußeren und auf äußeres Verhalten gerichteten sowie mit Zwang verbundenen, „strikten“ Naturrecht geführt, das besonders für das positive Recht bestimmend war. Diese Verengung auf ein striktes, äußeres, mit Zwang verbundenes (...) Naturrecht war allgemein anerkannt und wurde als Fortschritt begrüßt. Man muß annehmen, daß sie Kant wohlvertraut war. Sie wird etwa in Baumgartens Initia Philosophiae Practicae und auch in Achenwalls Jus Naturae erläutert, zwei Schriften, nach denen Kant Vorlesungen gehalten hat. Er hat die entsprechende Passage in der letzteren Schrift auch kommentiert. (shrink)

The article aims to clarify Kant's concept of law, which he developed in the “Metaphysische Anfangsgründe der Rechtslehre” from 1797. Decisive for Kant's concept of law is the distinction between internal and external relations of persons. Law is restricted to external relations. So the crucial question is: Where does Kant draw the line between internal and external relations? Four possibilities are analysed in an order of increasing extent: only causal consequences of our actions in the external world beyond our bodies; (...) causal consequences in the external world plus our externally empirical sensible bodily behaviour; causal consequences in the external world plus all physiological changes in the actor like nerve stimulations and brain activities; all features of plus all non-a-priori mental and emotional changes like emotions, inclinations, empirical concepts, hypothetical imperatives etc., in sum: Kant's division between homo noumenon and homo phaenomenon. While modern interpretations would perhaps endorse possibility, Kant has chosen – so the main argument of the article – the widest possible alternative. This brings him to a very extensive concept of law. Only in reflecting this wide extent of Kant's concept of law, we are able to understand his philosophy of law. (shrink)

This paper considers various senses of the notion of identity and describes the strongest sense of the term—what it labels “absolute identity.” Absolute identity combines monistic identity of all in all as one substance with the absence of internal differentiation. The paper explores the possibility of absolute identity along three lines—linguistic, mental, and ontological. It determines that though there are serious difficulties, linguistic and mental, involved with positing absolute identity the possibility of its coming to be real cannot be ruled (...) out. Finally, on grounds of its lack of coherence-functionality absolute identity is rejected as an adequate conception of the world. The paper closes with a discussion of the ramifications of the denial of absolute identity. (shrink)

Modern legal theory is in its mainstream characterized by two fundamental reductionisms. Law is no longer understood with reference to necessary aims like justice, self-preservation, or freedom, but only to contingent means. And the plurality of possible means and elements of law is reduced to norms, rules, and/or principles, therebyneglecting, or at least downsizing, other alternatives like concepts, institutes or institutions. This contribution will confront the second reductionism. This confrontation results in the thesis that concepts play a major role in (...) law, an even greater role than norms. In this article it will be tried to elucidate the role of concepts in law in five steps. First it will be asked what concepts are. Second the appropriate method for conceptual analysis will be analyzed. Third it will be questioned how concepts are related to each other in a conceptual scheme in general. Fourth this understanding of a conceptual scheme in general will be transferred to the conceptual scheme of the law. Fifth in a sort of meta-reflection it will be inquired if concepts or norms are prior in the law. (shrink)

. Gustav Radbruch is one of the most important German-speaking philosophers of law of the twentieth century. This paper raises the question of how to classify Radbruch's theories in the international context of legal philosophy and philosophy in general. Radbruch's work was mainly influenced by the southwest German school of Neo-Kantianism, represented by Windelband, Rickert, and Lask. Their theories of culture and value show an affirmative-holistic understanding of philosophy as a source of wisdom and meaningfulness. Kant, on the other hand, (...) belongs more to a fundamentally different, critical camp of philosophy. Although Radbruch has incorporated Kantian Elements into his theory, he is rather a member of the affirmative-holistic camp. In the end the question will be raised as to what ought to be preserved of his philosophy. (shrink)

The article aims to understand the phenomenon of law/the concept of law from a philosophical perspective. First, it is argued that law is a sort of human action. Therefore, the phenomenon of law can only be understood by analyzing the two main elements of human actions: aims and means. The aim of law is the mediation between possible contrary, conflicting concerns. The four parts of this aim are analyzed. But also morals and other social norms have a similar aim. So (...) law has to be distinguished from morals and these other social norms by its specific means. The specific means of law are its categorical character, its externality, its formality and - if law and religion are separated like in many modern societies - its immanence. (shrink)

In der 1970 gegründeten Reihe erscheinen Arbeiten, die philosophiehistorische Studien mit einem systematischen Ansatz oder systematische Studien mit philosophiehistorischen Rekonstruktionen verbinden. Neben deutschsprachigen werden auch englischsprachige Monographien veröffentlicht. Gründungsherausgeber sind: Erhard Scheibe, Günther Patzig und Wolfgang Wieland. Von 1990 bis 2007 wurde die Reihe von Jürgen Mittelstraß mitherausgegeben.

In der Reihe werden herausragende monographische Untersuchungen und Sammelbände zu allen Aspekten der Philosophie Kants veröffentlicht, ebenso zum systematischen Verhältnis seiner Philosophie zu anderen philosophischen Ansätzen in Geschichte und Gegenwart. Veröffentlicht werden Studien, die einen innovativen Charakter haben und ausdrückliche Desiderate der Forschung erfüllen. Die Publikationen repräsentieren damit den aktuellsten Stand der Forschung.

„The paper discusses Kant’s first argument from space in the „Critique of pure Reason”. It argues that, contrary to what parts of the literature have claimed, the argument provides convincing reasons for the view that in order to locate objects in space outside us we must already presuppose the idea of space such that it cannot be borrowed from the objects perceived in space. The paper shows how the argument can be made transparent not only by clarifying Kant’s usage of (...) “distinct from” and “ausser uns” but also by retracing its main idea back to the 1768 essay “Concerning the Ultimate Foundation of the Differentiation of Regions in Space” and its incongruent counterparts argument.”. Natürlichkeitsargumente haben allgemein in der Bioethik und speziell in der Debatte um Enhancement und Anthropotechnik keinen guten Ruf. Neben dem formalen Vorwurf, einen naturalistischen Fehlschluss zu begehen, werden sie mit dem inhaltli-chen Einwand konfrontiert, eine falsche Auffassung von menschlicher Natur zugrunde zu legen: Recht verstanden definiere sich diese menschliche Natur nicht durch eine biologische Substanz, die durch biotechnische Eingriffe korrumpiert werden könnte, sondern durch kulturelle Vollzüge, zu denen gerade auch der Einsatz biotechnischer Verfahren zähle und die daher durch biotechnische Manipulationen (...) am Menschen keineswegs beeinträchtigt, sondern eher noch bestätigt würden. Der vorliegende Beitrag unterzieht diese Argumentation einer kritischen Prüfung. Dabei zeigt sich, dass der Ansatz, den Menschen von seiner ‚Kultürlichkeit‘ statt von seiner ‚Natürlichkeit‘ her zu begreifen, tatsächlich keine glaubhafte Rechtfertigung von Anthropotechniken liefert, sondern im Gegenteil ein neues Argument gegen sie begründet: Anthropotechniken untergraben bei genauerem Hinsehen auch und gerade den Status des Menschen als Kulturwesen. Zusammenfassung Für ältere und hochaltrige homosexuelle Menschen ist die Wahrung der Identität im Pflegekontext häufig erschwert. Neben der generell vorherrschenden Tabuisierung oder Abwertung von Sexualität im Alter sind homosexuelle Personen zusätzlich oft mit heteronormativen Strukturen bis hin zu Diskriminierungserlebnissen konfrontiert. Literatur zum ethischen Handeln im Gesundheitswesen greift den Anspruch der Nichtexklusivität auf. Achtung und Würde stehen hierbei an erster Stelle und sollen allen Personen gleichermaßen zukommen. Diese systematische Literaturübersicht verfolgt das Ziel, anhand von wissenschaftlicher Literatur ethische Ansätze und pflegerische Unterstützungsangebote (...) herauszuarbeiten, die bei der Wahrung der Identität älterer und hochaltriger (> 60) homosexueller Menschen helfen können. Forschungsfrage: „Wie kann die Identität homosexueller älterer Menschen durch die Unterstützung von Pflegepersonen gewahrt werden?“ Anhand eines narrativen Reviews konnten sechs relevante Studien identifiziert werden. Die Recherche wurde in den Datenbanken PubMed und CINAHL durchgeführt. Drei Hauptkategorien wurden identifiziert, die für das Thema Homosexualität im Alter mit seinen Herausforderungen übergreifende Maßnahmenempfehlungen darstellen: Aufklärung und Schulung von Fachkräften, strukturelle Rahmenbedingungen und ein sicheres Umfeld durch eine bedarfsgerechte Versorgung. Pflegepersonen können die Wahrung der Identität homosexueller älterer Personen durch Anerkennung in Form von Zuwendung durch pflegerische Betreuung und soziale Wertschätzung fördern. Zudem ist es wichtig, dass eine rechtliche sowie strukturelle Gleichstellung homosexueller Personen im Pflegekontext und darüber hinaus erfolgt. Eine Auseinandersetzung mit ethischen Grundsätzen und Ansätzen ist hierfür unerlässlich. (shrink)

Since J. McTaggart’s paper on “The Unreality of Time” the opposition of “A-theorists” and “B-theorists” establishes a focal point in the modern debate on the metaphysics of time: While “A-theorists” claim the existence of an objective present, moving along time positions, “B-theorists” maintain that time is just a set of ontologically equivalent coordinates, “now” being merely the indexical of the speaker’s position. Contemporary attempts to resolve the issue by resorting to the analysis of language or to the theory of science (...) seem to deliver no definite results. By contrast, practical and existential aspects of the two models promise to be more univocal guides in deciding between them. Particularly, C. D. Broad’s hybrid conception of a “growing block theory” attains special attractiveness in this regard. (shrink)

Der vorliegende Band umfasst Beitrage zu einem zentralen Thema bei Platon: 'Physis' kann bei Platon im naturwissenschaftlichen Sinne als physische, biologische, materielle Natur oder im ubertragenen Sinne als eigenes Wesen, etwa hinsichtlich Seele, Kosmos oder Gottlichem, verstanden werden. So werden in diesem Band medizinische, biologische und kosmologische Ansatze ebenso wie ontologische, epistemologische und padagogische Themen zu Platons 'Physis'-Konzept fokussiert. Die zeitgenossische Nomos-Physis-Diskussion Platons mit den Sophisten sowie seine sprach- und kulturphilosophischen Uberlegungen spielen hier eine wichtige Rolle. Die anspruchsvolle literarische Gestaltung (...) der Platonischen Dialoge ist fur die genannten Fragestellungen hochst relevant, ebenso die Auseinandersetzung spaterer platonischer Philosophen mit Platons Physis-Konzept.
